Cloud 9 Accommodation terms and conditions

BOOKING TERMS AND CONDITIONS

Booking a property is very different from booking a regular hotel room, particularly regarding payments and cancellations. Please read the following conditions carefully.

1. AGREEMENT

1.1 Cloud 9 property management (“Cloud 9”) acts as a property management company for chalet owners (“Owner”). Each time a guest confirms a booking of a property through Cloud 9, a rental contract is entered into between Cloud 9 and the guest in whose name the booking is made (the “Guest”) for the agreed period (“Rental Period”).

1.2 Each time a guest books a property through Cloud 9, the guest is deemed to have accepted these terms and conditions. The rental contract is not effective until Cloud 9 has confirmed the guest’s booking in writing.

1.3 The person whose name appears first on the booking form shall be deemed to be the group leader. He or she shall be regarded as the representative of the group, have authority to accept and does accept these terms and conditions on behalf of the group, and be liable for the payment of all monies owed by all members of the group to Cloud 9.

1.4 The “group” refers to all persons booked to stay in the accommodation listed on the booking, including any subsequent name changes.

 

2. BOOKING, DEPOSIT AND PAYMENT

2.1 Once availability has been confirmed by Cloud 9, a booking will be held for five working days, pending receipt of the required deposit.

A minimum deposit of 50% of the total booking price is due at the time of booking in order to secure the rental.

For bookings made within 10 weeks of the rental period, the full booking amount is payable at the time of booking.

2.2 If the required deposit and/or balance is not received within five working days, the booking will, at Cloud 9’s discretion and without notice, be cancelled.

2.3 Unless otherwise agreed, the balance of the booking (50%) must be paid to Cloud 9 no later than 10 weeks before the start of the chalet rental.

2.4 In certain cases the owner of the chalet may require a damage deposit. Guests will be advised if this applies at the time of booking.

2.5 All bank transfer charges and online payment fees are to be borne by the sender.

 

3. PRICES

3.1 All prices stated on our website are in Japanese Yen (¥).

3.2 Cloud 9 guarantees the price of accommodation as quoted at the time of booking and reserves the right to increase or decrease the price of unsold accommodation at any time.

3.3 Prices quoted are for chalet hire only unless otherwise stated. Generally, there are no additional costs, surcharges, tips or management fees above the total quoted price unless specified in the property description or booking confirmation. An additional cleaning fee may apply; details will be provided at the time of booking.

3.4 Prices do not include travel, transfers, holiday or medical insurance, ski passes, childcare, equipment hire, ski lessons, meals or similar.

3.5 A security deposit may be required for certain properties. If so, this will be notified at the time of booking.

3.6 Once a booking has been confirmed, the price of the reservation is guaranteed, even if Cloud 9 later changes the price on its website. No refunds will be made due to exchange rate fluctuations.

3.7 Cloud 9 reserves the right to pass on any taxes or charges imposed by government or regulatory bodies after the time of booking. Guests will be informed promptly if this occurs. All properties are subject to Japanese consumption tax (currently 10%).

 

4. CANCELLATION BY CLOUD 9

4.1 If Cloud 9 is forced to cancel a booking due to circumstances beyond its control, a full refund will be provided. This does not include events deemed Force Majeure (including war, political unrest, extreme weather, strikes, acts of God, epidemics, pandemics, riots, civil disorder, industrial disputes, terrorism, natural disasters, technical failures, or government state of emergency) or cancellations arising from the guest’s failure to make payments on time.

 

5. CANCELLATION BY THE GUEST

5.1 The guest, or any member of their party, may cancel the chalet booking at any time, provided that the cancellation is made in writing by the group leader and confirmed by Cloud 9.

5.2 The following cancellation charges apply:

  • More than 24 weeks before arrival: loss of the 25% deposit.
     

  • More than 10 weeks before arrival: loss of the 50% deposit.
     

  • Within 10 weeks of arrival: 100% of the total booking amount.
     

  • No-shows: 100% of the total booking amount.
     

 

6. LIMITATION OF LIABILITY

6.1 Cloud 9’s liability is limited to the cost of the chalet hire. It does not extend to additional costs or losses such as travel, pre-booked services or ski passes.

6.2 Cloud 9 cannot control weather conditions, nor guarantee snow quality or ski area operations. No refunds or compensation will be given for cancellations, interruptions or restrictions due to weather or other circumstances beyond Cloud 9’s control.

6.3 Cloud 9 accepts no responsibility or liability for third party services, as outlined in section 10 (Third Party Activities and Excursions).
